Bitgrail - To all the creditors

Vi invitiamo a prendere nota delle informazioni qui di seguito indicate, con la precisazione che le stesse sono applicabili sia con riferimento al Fallimento Webcoin solutions di F.F. (Trib. Firenze; R.G. n. 15/2019; G.D. Dott.ssa M.N. Legnalioli), sia Fallimento BG Services s.r.l. (Trib. Firenze; R.G. n. 16/2019; G.D. Dott. C. Soscia).

Intanto Vi confermiamo che è in corso di esecuzione il terzo riparto per il Fallimento BG Services s.r.l..

Vi segnaliamo poi che, a partire dal 30 novembre 2023, la piattaforma informatica predisposta dalla procedura cesserà di funzionare.

Conseguentemente, per la comunicazione dei dati bancari necessari per la emissione dei bonifici a Vostro favore da parte del Fallimento, abbiamo la seguente situazione.

Vi ricordiamo nuovamente che per motivi di sicurezza la piattaforma fallimentobitgrail.it NON consente di modificare l’email utilizzata durante la registrazione e/o reimpostare il PIN. Pertanto, nel caso in cui abbiate perso il PIN, non potrete utilizzare la piattaforma per la comunicazione dei dati bancari, dato che il PIN non potrà essere reimpostato e pertanto dovrete comunicare i dati bancari con una delle seguenti alternative a Vostra disposizione (salve le altre consentite per legge):

(A) è possibile fissare un appuntamento con i Curatori del Fallimento (nella loro sede di Firenze) presso i quali depositare i dati bancari e copia dei documenti di identificazione;

(B) è possibile farsi rappresentare da un avvocato del foro italiano. L’avvocato dovrà inviare alla procedura (PEC: [email protected] e [email protected]) il documento d’identità della parte, la procura e indicare le coordinate bancarie del creditore. Diversamente se intende incassare per conto del cliente la procura deve contenere il potere di incassare somme per conto del cliente;

(C) se possibile nel Vostro paese d’origine, potete fare una dichiarazione autenticata da un pubblico ufficiale dello Stato di residenza (es. un notaio), che dovrà essere autenticata dal Consolato italiano locale e dovrà poi essere trasmessa per email/PEC al Fallimento. Nella dichiarazione dovranno essere indicati:

c1. l’indirizzo e-mail utilizzato per la registrazione alla piattaforma fallimentobitgrail.it e, se diverso, l’indirizzo e-mail utilizzato per la registrazione alla piattaforma bitgrail.com;

Sarà poi possibile inviare la dichiarazione autenticata via e-mail e, successivamente, la dichiarazione autenticata e originale per posta all’ufficio dei Curatori, in Italia (vedi indirizzi https://bitgrail.com/).

A partire dall’1 dicembre 2023, come sopra detto, la piattaforma non sarà più disponibile. Pertanto i dati bancari di coloro che saranno ammessi al passivo di ciascun fallimento potranno essere comunicati soltanto attraverso una delle seguenti alternative a Vostra disposizione (salve altre consentite per legge):

(A) è possibile fissare un appuntamento con i Curatori del Fallimento (nella loro sede di Firenze) presso i quali depositare i dati bancari e copia dei documenti di identificazione;

(C) se possibile nel Vostro paese d’origine, potete fare una dichiarazione autenticata da un pubblico ufficiale dello Stato di residenza (es. un notaio), che dovrà essere autenticata/legalizzata dal Consolato italiano locale e dovrà poi essere trasmessa per email/PEC al Fallimento. Nella dichiarazione dovranno essere indicati:

c1. l’indirizzo e-mail utilizzato per la registrazione alla piattaforma fallimentobitgrail.it e, se diverso, l’indirizzo e-mail utilizzato per la registrazione alla piattaforma bitgrail.com;

c3. la propria identità (con il proprio documento d’identità, che dovrà essere allegato al predetto atto).

Qualsiasi altro strumento di comunicazione dei dati bancari (es. invio tramite email, ecc..) non sarà ritenuto valido da parte del fallimento (sempre salvi gli altri metodi eventualmente consentiti per legge).

In assenza dell’indicazione dei dati bancari (nelle forme sopra indicate), il pagamento non potrà avvenire.

Una volta che il progetto di riparto sarà stato approvato, è fisiologico che trascorra un lasso di tempo anche non breve, in quanto sarà comunque necessario attendere i tempi tecnici per ricevere il pagamento. Infatti, a causa dell’elevato numero di creditori ammessi al riparto e dei numerosi errori riscontrati dagli scriventi con riferimento ai dati comunicati, sarà comunque necessario attendere per ottenere il materiale pagamento:

- l’espletamento da parte del Tribunale di Firenze delle formalità previste dalla legge fallimentare;

- i tempi tecnici volti alla disposizione dei pagamenti e l’accredito sui vostri conti bancari da parte della Banca incaricata dal fallimento;

A partire dal 1 dicembre 2023, sempre in conseguenza della cessazione del funzionamento della piattaforma, in caso di insinuazione tardiva al passivo delle due procedure sarà possibile insinuare al passivo il proprio credito mediante invio di un ricorso alla PEC di ciascuna procedura (PEC: [email protected] e [email protected]).

Vi ricordiamo che, ai fini della presentazione dell’insinuazione al passivo del proprio credito al passivo del fallimento, è indispensabile dimostrare che il ritardo è dipeso da cause non imputabili all’istante. Pertanto le domande tardive sono ammissibili solo se l’istante prova che il ritardo è dipeso da causa a lui non imputabile. In mancanza della predetta prova le domande saranno rigettate.

We confirm that the third distribution plan for the Bankruptcy BG Services s.r.l. is currently in progress.

We would also like to inform you that, starting from November 30, 2023, the procedure’s it platform will cease to function.

Consequently, for communication of the necessary bank details for transfers in your favor by the Bankruptcy, please note the following.

The instructions provided in the FAQ section, which is regularly updated, as well as other communications on https://bitgrail.com, remain valid.

REMINDER: for security reasons, the fallimentobitgrail.it platform does NOT allow you to change the email used during registration or reset the PIN. If you have lost your PIN, which cannot be reset, you will NOT be able to use the platform to communicate your bank details. In this case, you must communicate your bank details using one of the following alternative methods (in addition to the others allowed by law):

If the lawyer intends to collect on behalf of the client, the power of attorney must specify the authority to collect sums on behalf of the client.

C1. The email address used to register on fallimentobitgrail.it and, if different, the email address used to register on bitgrail.com;

The notarized declaration can be sent by email and later the notarized original can be sent by post to the Curators' office in Italy (addresses available at https://bitgrail.com/).

Starting from December 1st, 2023, as mentioned earlier, the platform will no longer be available. Therefore, bank details for those admitted to the liabilities of each bankruptcy can only be communicated through one of the following alternative methods (additional to those allowed by the law):

If the lawyer intends to collect on behalf of the client, the power of attorney must specify the authority to collect sums on behalf of the client.

Bank details sent via any other means (e.g., via e-mail, etc.) will not be considered valid by the Bankruptcy procedure (except for those communicated in a form that the law allows).

In the absence of the indication of bank details (in the forms indicated above), the payment cannot be made.

Upon approval of the distribution plan, a period of time will naturally elapse before payment is received. Due to the high number of creditors admitted to the distribution plan and errors found by the Trustees in the communicated bank details, it will still be necessary to wait for:

Starting from December 1st, 2023, following the platform's cessation, late filing of claims in the liabilities can be made by sending an appeal to the PEC of each procedure (PEC: [email protected] and [email protected]).

the second plan for the distribution of proceeds for the Webcoin Solutions Bankruptcy is currently in progress, that provides for the payment of 13% of the allowed claims. It will then be possible to send the authenticated declaration by e-mail and, subsequently, the authenticated and original declaration by post to the Bankruptcy Trustees office, in Italy (you can the address at https://bitgrail.com/).

Any other means of communication (without prejudice to the others permitted by law) for the bank details (e.g. sending documents via email, etc.) will not be considered valid by the bankruptcy.

Once the plan for the distribution of proceeds has been approved, it will still be necessary to wait a few months to receive the payment. OGGETTO: Rinvio udienza verifica stato passivo del 28 ottobre 2021, ore 9:30

Si rende noto che il Giudice Delegato al fallimento in oggetto con provvedimento del 13 ottobre 2021 ha disposto che l’udienza per l’esame delle domande “tardive” originariamente fissata per il giorno 28 ottobre 2021 si tenga il 13 gennaio 2022 stesso luogo e ora.

Conseguentemente tutti i termini indicati nei precedenti avvisi e comunicati (con riferimento alla predetta udienza del 28 ottobre 2021) debbono riferirsi alla predetta data del 13 gennaio 2022.

We inform you that the Bankruptcy Judge with a decree dated October 13, 2021, has postponed the hearing which was to be held on October 28, 2021, to January 13, 2022, at 9,30 (AM).

Therefore all the terms and deadlines mentioned in the previous communications (with respect to the October 28 hearing) are to be referred to the said date of January 13, 2022.

We highlight that at the hearing of January 13, 2022, the Judge will examine also the claims filed after the deadline of September 17, 2021. Dato che moltissimi creditori non hanno ancora capito lo stato delle procedure e pervengono continue richieste di chiarimento, ricordiamo (nuovamente) quanto segue.

Come noto il Tribunale di Firenze con riferimento al fallimento del dissesto della piattaforma Bitgrail ha aperto due distinte procedure fallimentari e precisamente:

1. L’esame delle Vostre domande (tempestive, i.e. presentate prima entro l'11 febbraio 2020, in qualsiasi forma esse siano state indirizzate alla procedura) si è concluso con la dichiarazione di esecutività dello stato passivo da parte del G.D. (udienza dell’11 giugno 2020). Di tale stato passivo avete ricevuto copia nei giorni 24/25 giugno 2020. In tale documento avete trovato la collocazione del Vostro credito in relazione alla procedura 15/2019 (Fall. Webcoin Solutions). Vi ricordiamo che potete proporre ricorso ai sensi degli artt. 98 e 99 l. fall.. Vi ricordiamo altresì che se la Vostra domanda è stata dichiarata inammissibile (e.g. mancata identificazione) potete ripresentare la domanda che verrà esaminata nell’udienza successiva (i.e. se presentata entro l’8 settembre 2020, dato che la prossima udienza è già fissata per il giorno 8 ottobre 2020).

(a) nel Fallimento Webcoin Solutions non sono state rinvenute dai curatori criptomonete appartenenti agli utenti e pertanto tutte le domande di restituzione della criptovaluta sono state respinte;

(b) il controvalore del Vostro credito è stato calcolato in questo fallimento con riferimento alla data della dichiarazione del fallimento (21-1-2019) e pertanto possono registrarsi differenze nei valori delle criptovalute da Voi attribuiti con quello che esse avevano a quella data;

(c) gli interessi non sono stati riconosciuti, dato che, come sopra detto, il credito è stato individuato alla data del fallimento.

3. La piattaforma tornerà a essere disponibile per il deposito delle domande di insinuazione tardive dopo il 17 luglio 2020.

1. In questi giorni stiamo predisponendo il progetto di stato passivo contenente le proposte dei curatori relativamente alle Vostre domande, da sottoporre al giudizio del G.D. all’udienza del 16 luglio 2020. Riceverete entro il 1 luglio 2020 il progetto di stato passivo. Coloro che hanno effettuato l’insinuazione mediante la piattaforma predisposta dal Tribunale, stanno già ricevendo in anticipo le proposte dei curatori che saranno contenute nel progetto di stato passivo. Dal 2 luglio in poi e fino all’11 luglio 2020, potrete far pervenire le Vostre osservazioni al progetto di stato passivo, che verranno esaminate da parte dei curatori e poi anche del G.D.

2. Vi ricordiamo ancora che nell’ambito di questo fallimento, gli scriventi curatori, nell’esaminare le domande stanno seguendo, fra gli altri, i seguenti criteri:

(a) proponiamo che le domande di rivendica/restituzione della criptomoneta non vengono accolte, in quanto è stato deciso in via definitiva dalla Corte d’Appello di Firenze (confermando quanto statuito dal Tribunale di Firenze) che la piattaforma Bitgrail gestiva “in monte” e “indistintamente” le criptovalute affidatele dai clienti. Per fare un esempio è come se la piattaforma Bitgrail avesse operato come una banca con i depositi di denaro effettuati dai depositati presso la banca stessa. Siete comunque liberi (i) di avanzare la richiesta di restituzione che verrà decisa dal G.D. oppure (ii) di convertire la domanda di rivendica già avanzata in sede di osservazioni al progetto di stato passivo (che potrete dal 2 luglio 2020 fino all’11 luglio 2020) in domanda di insinuazione del credito;

(b) il controvalore della criptomoneta è stato calcolato alla data che esse avevano al 9 febbraio 2018. Per errore materiale in alcune occasioni è stato comunicato che il controvalore utilizzato dai curatori era alla data dell’8 febbraio 2020. Si tratta di un errore materiale, dato che, come sopra rilevato, l’importo è stato calcolato alla data del 9 febbraio 2020;

(d) i creditori che non si sono identificati nelle forme previste dalla legge non verranno ammessi, così come non sono stati ammessi nell’ambito del Fallimento Webcoin Solutions. Forme consentite di identificazione per i curatori sono senz’altro le seguenti: procura al legale, identificazione tramite l’app. Dizme sulla piattaforma, oppure altre forme ammesse dalla legge italiana (ivi inclusa la comparizione personale all’udienza del 16 luglio 2020). Si prega di leggere nuovamente le istruzioni contenute nelle FAQ https://bitgrail.com/claimfaq.htm.

You have received a copy of such decision on June 24/25, 2020. Such decision provided only for your claims filed in connection to procedure n. 15/2019 (Fall. Webcoin Solutions). We remind you that you could appeal such decision within 30 days starting from the said communication under artt. 98 e 99 of Italian bankruptcy law. We also remind you that if your claim has been declared inadmissible (e.g. for lack of identification) you could file a new claim which will be decided at the following hearing (i.e. if the claim is filed within September 8, 2020, since the new Court hearing has already been established for October 8, 2020).

(a) in the Webcoin Solutions bankruptcy there were not any cryptocurrency found by the Trustees which were owned by the creditors and therefore all the restitution claims have been rejected;

(b) the value attributed to your claim was calculated at the bankruptcy date (Jan 21, 2019). Therefore there have been differences in the value you were awarded with respect to the value you have claimed;

3. The platform will become available again for the late claims on July 17, 2020.

1. We are currently preparing the “stato passivo” draft containing our proposals with respect to your claims. The said draft will be scrutinized by the Delegated Judge on the July 16, 2020, hearing. You will receive within July 1, 2020, the new “stato passivo” draft. Those of you who have filed their claims through the platform created by the Court of Florence are already receiving the bankruptcy trustees’s proposals which are going to be contained in the “stato passivo” draft. 2. We remind you again that within this bankruptcy procedure (Fall. BG Services s.r.l. (Trib. Firenze – RGF n. 16/2019), the bankruptcy trustees in reviewing the claims (among others) are following these criteria reported hereinbelow.

(a) we are proposing the rejection of cryptocurrency restitution claims, because the Court of Appeal of Florence (by confirming what the Court of Florence had decided) found that the Bitgrail platform has held and managed the cryptocurrency which the creditors transferred on it in a single amount “in monte” (putting them all in a single wallet) and “without distinction”. Exemplifying it was as if the Bitgrail platform operated like a bank with the clients’ cash deposits. However you are totally free either (i) to insist in your restitution claim which will be decided by the Delegated Judge (at the hearing date) or (ii) to convert your restitution claim into a claim for euro and you could do that with your comments and requests for amendments to the “stato passivo” draft (which you could file starting from July 2, 2020, until July 11, 2020);

(b) the cryptocurrency value has been calculated at the date which they had on February 9, 2018. For a clerical error, a number of creditors have been communicated that the value employed by the bankruptcy trustees was the value the cryptocurrency had on February 8, 2020. It is just a clerical error, since as mentioned above, the value employed was the value the cryptocurrency had on February 9, 2020;

(d) creditors that have not identified themselves in a manner compliant with Italian law will not be allowed, as they have not been allowed in the Webcoin Solutions bankruptcy procedure. Allowed form of identification for the bankruptcy trustees are the following: power of attorney to a lawyer, identification thourhg the Dizme app on the platform, or any other form compliant with Italian law (including showing up at the hearing of July 16, 2020). Rendiamo noto che con provvedimento del 22.05.2020, il G.D. del fallimento di B.G. Service s.r.l. (Trib. Firenze - RGF n. 16/2019), visti i decreti-legge nn. 18/2020 e 23/2020, nonché le disposizioni del decreto n. 60/2020 e 62/2020 del Presidente del Tribunale; ha rinviato l’udienza per l’esame dello stato passivo del fallimento già fissata per il 2 luglio 2020 all’udienza del 16 luglio 2020 ore 9,00 per i medesimi incombenti.

Please be advised that with decree dated 22 May, 2020, the B.G. Service s.r.l. Bankruptcy Judge (Court of Florence – ‘RGF’ Protoc. n. 16/2019), given the decrees-law nn. 18/2020 and 23/2020, as well as the regulations of decree no. 60/2020 and 62/2020 of the President of the Court; has postponed the hearing for the examination of the bankruptcy claims already scheduled for July 2^nd, 2020 to the 16^th July, 2020 at 9.00 am, hearing.

Gli scriventi curatori in merito alle Vostre domande di ammissione allo stato passivo ad oggi ricevute ritengono opportuno informare e precisare quanto segue:

Per queste domande i curatori propongono il non accoglimento, in quanto nel fallimento di WebCoin Solutions di Firano Francesco non vi sono criptomonete e pertanto la restituzione non è possibile.

La norma (art. 103 L.F.) prevede che il creditore possa modificare la propria domanda (originariamente formulata con la restituzione della criptovaluta) e chiedere l’ammissione al passivo del controvalore in euro della criptomoneta alla data di apertura del fallimento.

Tale modifica potrà da Voi essere effettuata, anche utilizzando la piattaforma, fino al 6 marzo 2020 (Italian time) oppure nel corso della stessa udienza di esame dello stato passivo (12 marzo 2020 ore 10:00, CET).

Talune domande di ammissione verranno ammesse allo stato passivo di WebCoin Solutions di Firano Francesco per un importo ridotto rispetto al controvalore richiesto dal creditore.

Ciò dipende dal fatto che i Curatori hanno proceduto al ricalcolo del valore delle criptomonete che risultano legittimamente possedute dal creditore alla data di dichiarazione del fallimento (in questo caso 21/01/2019), secondo le risultanze del database.

Inoltre, a questa data il valore della criptomoneta risultava anche sensibilmente diverso da quello corrisposto dall’utente della piattaforma Bitgrail al momento dell’acquisto e/o alla data in cui la piattaforma ha cessato di operare.

I Curatori, nell’ambito del fallimento BG Services s.r.l. (proprietario finale della piattaforma Bitgrail), hanno intenzione di proporre una diversa valutazione del credito (più favorevole ai creditori) richiesto per l’ammissione.

Talune domande non risultano accolte (inammissibili) in quanto il creditore non ha effettuato la procedura di identificazione indicata dalla piattaforma per chi ne ha fatto uso, o non ha seguito una procedura di certificazione del documento allegato alla domanda secondo la normativa vigente. L’eventuale decisione assunta dal Giudice Delegato di dichiarazione di inammissibilità della domanda non impedisce al creditore di riproporla (integrata con i dati richiesti), senza ulteriori aggravi per il creditore. Si noti che il termine ultimo per sottoporre la domanda al fallimento è di un anno a partire alla data in cui il Giudice Delegato ha reso esecutivo lo stato passivo.

Laddove i curatori abbiano ritenuto il credito non provato, ciò significa che possono sussistere diverse motivazioni, fra cui:

(i) mancata prova di titolarità dell’email indicata sul sito Bitgrail (la piattaforma messa a disposizione della procedura consente di provare facilmente la sussistenza del requisito – la maggior parte dei creditori che hanno insinuato il proprio credito per mezzo della piattaforma sono riusciti a dimostrare il requisito richiesto);

(ii) errate informazioni sulle caratteristiche dell’account dell’utente oppure sulla criptovaluta detenuta in portafoglio;

(iii) mancata presenza sul database Bitgrail. Il creditore può dimostrare che deteneva su Bitgrail, producendo idonea documentazione (per esempio la sola produzione di screenshot non è sufficiente).

I creditori che hanno depositato le proprie domande entro il giorno 11 febbraio 2020 (orario italiano), possono integrare le proprie domande fornendo ulteriore documentazione fino al 6 marzo 2020 (orario italiano).

Le domande presentate dai creditori dopo l’11 febbraio 2020 saranno considerate tardive e saranno esaminate nelle prossime udienze fissate dal giudice.

I creditori che hanno insinuato il proprio credito al passivo del fallimento a mezzo email e/o a mezzo PEC possono integrare fino al 6 marzo 2020 – laddove lo ritengano necessario e/o opportuno – la propria domanda di insinuazione al passivo anche mediante l’utilizzo della piattaforma messa a disposizione dei creditori all’indirizzo web https://www.fallimentobitgrail.it/login. In fact, the rule (laid down by Art. 103 Italian Bankruptcy Law) provides that the creditor may modify the application (originally formulated for the return of the cryptocurrency) and request the lodgement to the bankruptcy of the equivalent value in euro of the cryptocurrency on the date of the opening of the bankruptcy procedure.

You may provide to this modification directly, also with the use the platform, up to 6 March 2020 (Italian time) or during the same hearing for the examination of the bankruptcy case (12 March 2020, at 10:00 o’ clock CET).

Certain applications for lodgement shall be admitted to the bankruptcy WebCoin Solutions di Firano Francesco for a reduced amount compared to the value requested by the creditor.

This depends on the fact that the Trustees have proceeded to recalculate the value of the cryptocurrencies that are legitimately owned by the creditor to the date in which the bankruptcy was declared (in this case 21 January 2019).

Also, on the date mentioned above, the value of the cryptocurrency was significantly different from the amount paid by the user of the Bitgrail platform at the time of purchase and/or on the date on which the platform ceased to operate.

The Trustees, within the context of the bankruptcy BG Services s.r.l. (final owner of the platform Bitgrail), have decided to propose a different evaluation of the credit (more favourable to creditors).

Certain applications have not been accepted, because the creditor has not carried out the identification procedure indicated by the platform for those who have used it or has not followed a certification procedure for the document attached to the application according to current legislation. Any decision by the Bankruptcy Judge to declare the application inadmissible does not prevent the creditor from re-proposing the same application (integrated with the requested data), without further costs for the creditor. Please note that the final term to submit a claim with the bankruptcy procedure is one year starting from the date when the first court decision has been made.

Where the Trustees have considered the credit unproven, this means that there may be several reasons, including:

(i) failure to prove ownership of the email indicated on the Bitgrail website (the platform made available by the bankruptcy procedure allows you to easily prove the existence of the requirement – a vast majority of the creditors that filed their claim through the platform were able to prove it); (ii) incorrect information on the characteristics of the user's account or on the cryptocurrency held in the portfolio;

(iii) lack of presence on the Bitgrail database. The creditor may prove that he detained coins on Bitgrail by producing suitable documentation (e.g. the production of the screenshots only is not sufficient).

Creditors who submitted their applications within the deadline set at the end of the day February 11, 2020 (Italian time), may integrate their applications by providing additional documentation by March 6, 2020.

Applications submitted by creditors after February 11, 2020 will be considered late and will be examined during the next hearings that will be scheduled by the judge.

Creditors who have lodged their claim to the bankruptcy by email and/or by PEC may integrate by 6 March 2020 - where they deem it necessary and/or appropriate - their application to lodge their claim with the use of the platform made available to creditors at the webpage https://www.fallimentobitgrail.it/login. In this case (where a creditor timely submitted his claim via email/PEC and then register to the platform), as regards the timeliness of the application, the Trustees will consider the date of receipt of the email and/or PEC as the date of the lodgement of the claim to the bankruptcy.

2) The hearing to determine the “Stato passivo” in the bankruptcy procedure of BG SERVICES SRL is going to be held on October 07, 2019, at 09:00 am, at the Tribunale di Firenze in front of the G.D. Dott. Cristian Soscia;

3) The communication to the creditors under art. 92 of the Italian bankruptcy law containing all the relevant information in order to allow all the creditors to file their proof for claim with the Court is being prepared by the bankruptcy trustees and will be made available to all creditors as soon as possible. It will contain all the relevant information in order for the creditors to file their proof of claim under art. 93 of the Italian bankruptcy law;

4) The proof of claim by each creditor shall be filed with the bankruptcy trustee within 30 days before the date of each hearing;
